Fifteen years of Fixed-term Imprisonment is already an extremely severe sentence for a minor.

Therefore, He Tianying’s Criminal Record was naturally not a simple case of fighting.

On July 15, 1997, in the Outskirts Forest of Xishan County, 16-year-old He Tianying raped and murdered a 19-year-old girl named Fu Yangzhi.

After the crime, He Tianying buried the body on the spot and surrendered himself the next day through Voluntary Surrender.

During the trial that year, he truthfully confessed his motive for the crime.

He said he liked that older sister, but she and his brother were a pair. As long as his brother was around, he would never be noticed, would never have a chance, so he decided to create an opportunity.

It is clear that the motive for He Tianying’s first crime was related to his relationship with his brother.

He Tianying had been introverted and self-abased since childhood, jealous of He Tianxing because He Tianxing was too outstanding.

He Tianxing was gifted, cheerful, handsome, and sunny; while He Tianying was mediocre, sullen, and had a gloomy appearance, making him pale in comparison to his brother.

They were both children of their parents, yet worlds apart. He Tianying felt psychologically unbalanced and could not control his jealousy toward his brother.

These feelings had always been suppressed in his heart, until He Tianying saw the girl his brother liked.

That girl was named Fu Yangzhi. She was the same age as his brother, sunny in disposition, beautiful, academically excellent, and as dazzling as his brother.

The person He Tianxing liked, He Tianying also liked. He would always hide in the shadows, secretly watching He Tianxing and Fu Yangzhi walk home together after school, watching them blush as they discussed math problems.

He Tianying knew that such a good girl would only like someone like his brother, and would never notice someone as mediocre and dull as himself. If he wanted her, he could only resort to extreme measures.

He couldn’t even tell if he truly liked Fu Yangzhi, or if he simply wanted to possess someone his brother liked. In any case, he vented all his long-suppressed jealousy, anger, and resentment in the most irreparable way.

That girl had just finished her college entrance exam, and a brilliant life was about to begin, but she was forced to remain forever at the age of 19 in such pain.

Looking at the perpetrator, He Tianying, he was just one month shy of turning 16. Because he committed the serious crimes of Intentional Homicide and Rape, he had to bear criminal responsibility; but as a minor, with Voluntary Surrender and a good Attitude of Confession and Remorse, he was still given a lighter sentence.

In the end, He Tianying was convicted of Intentional Homicide, Intentional Injury, and Rape, and received Combined Punishment for Multiple Crimes: fifteen years of Fixed-term Imprisonment, plus civil compensation of more than 28,000 yuan.

Because of good behavior during his sentence, he received several sentence reductions and was released after serving thirteen years.

During the trial that year, He Tianying seemed relieved, pouring out his dark thoughts in detail. He expressed apologies to the Victim, the Victim’s family, his parents, and his brother, and showed an Attitude of Confession and Remorse.

But seventeen years later, as we see now, did he truly feel remorse?

With the same criminal motive as before, he committed another crime-even more brazenly, directly refusing to confess.

Who does our Juvenile Protection Law really protect?

Retribution will come sooner or later, but unfortunately, it came fifteen years too late, costing two innocent lives.

I closed the case file, feeling my temples throb.

Such a Criminal Record is extremely serious; it basically seals this person’s fate.

At first, I believed his lies and enthusiastically took on the case.

Now, after reading the Criminal Record, the thought of providing Defense for such a Beast truly weighs on my conscience.

People really must pay the price for their impulses.

After deep reflection, I submitted an application to the Detention Center to meet with the suspect.

In 2012, I took over an extremely tricky case.

The defendant in this case had consecutively been convicted of serious crimes twice, with no mitigating circumstances and absolutely no room...
